Application Strategy for Intellectual Property Rights

Invention Related to Duties
▶ Intellectual property created by faculty related to his/her current duties, using the research facilities and manpower of the school
▶ Intellectual property that has been created as a result of executing a project based on research expenses support received from this school, an affiliate of the school, a ministry of the government or any affiliated institutions
▶ Intellectual property whose rights are with the school due to law, or a research outsourcing contract with a third party

Ownership of Intellectual Property
Any intellectual property that has been created by the faculty of the school in relation to their respective duties should be owned by the SNU R&DB Foundation as per Article 10-2 of 「Invention Promotion Act」, Article 27-2 of the 「Law Regarding Industry Education Promotion and Education-Industrial Cooperation Promotion」 and Article 6 of 「Seoul National University Regulations regarding Intellectual Property Rights Management」

Duty to Declare Work-related Invention and Succession
▶ In case an inventor has performed work-related invention, he/she must draw up a work-related invention declaration form and submit to SNU R&DB Foundation
▶ Head of SNU R&DB Foundation must notify the inventor of succession of rights within four months of the declaration upon completion of deliberation of the Intellectual Property Rights Management Committee

 

IP Prosecution Procedure

Investigation by Inventor of Previous Technology Options

The inventor must investigate beforehand whether the invention of the current year actually qualifies as a patent item compared to previously available documents

Previously available documents include dissertations, patents etc., and the results of the investigation of previous technology options must be submitted at the time of declaration of invention

Detailed Description
·Receipt of Declaration of Invention
- Declare to SNU R&DB Foundation Intellectual Property Management team via e-mail(snuif2@snu.ac.kr) and submit the original document.
- Required documents: Declaration of invention and declaration form chosen by the patent attorney, invention proposal, and investigation results of previously available technology.
·Inventor Consultation
- The team head of each technology field from the SNU R&DB Foundation R&DB project division should hold an interview with the inventor (an outside patent application agent may be present if deemed necessary).
- The patent application agent should hold an interview with the inventor separately and review the validity of the patent application based on previously available technology.
·Deliberation of Expense Support Limit
- Deliberation of whether to support application expenses based on the validity, technological merit, and commercial potential (possibility for widespread use and technology transfer) of the invention.
- Commercial potential is the considered the most important factor, and other factors, such as the total year expense budget of the research lab, cost of technology transfer, and past performance in academic-industrial cooperation, may be taken into consideration.

Expense support for reserve patent application

▶ The reserve patent application procedures should be followed in case prompt patent application is necessary (an application whereby the invention proposal of the inventor is supplemented to enable application process without evaluation with the purpose of obtaining and application date)
▶ The national priority rights application (application must be made within one year of reserve patent application) should follow the same procedure as the new applications
▶ Any cases, where funding has not been decided, should be requested to the research lab, and any cases, that have been approved by the SNU R&DB Foundation can follow the reserve

Receipt of Declaration of Invention

Program

Declaration and receipt of invention

▶ Send declaration to Intellectual Property Management Office Intellectual Property Management team via e-mail (snuif2@snu.ac.kr) and submit the original document
▶ Required documents: Declaration of invention (Agreement for succession of rights) and invention proposal

Input information in the Korea Copyrights Committee website

▶ Input the contents of the program at www.cros.or.kr as an applicant (agent), using the researchers individual certificate
▶ If the copyrights holder is input as Seoul National University SNU R&DB Foundation, the application must obtain delegation and agreement from the school at the final stages.
▶ Program registration is complete after the program cost has been paid and the delegation and agreement of the SNU R&DB Foundation has been obtained

Program registration expenses

▶ In case payment in advance from the SNU R&DB Foundation is not possible, the researcher must first pay the expenses individually and then bring the receipt and copy of bank account and the program registration certificate to the research lab, and the expenses will be transferred to the researcher's (must be one of the inventors) bank account
※ Individual credit cards may not be used when paying registration expenses, only research credit cards are allowed.

Performance Acknowledgement

In order to obtain performance acknowledgement, the inventor must input his/her name (first six digits of resident registration number) when updating the column "persons involved in work-related creation" within the "program overview tab".

Maintenance and Management of Intellectual Property

Program

Maintenance Period and Abandonment of Intellectual Property Rights

▶ Maintenance period of Intellectual Property Rights (Article 8-1 of the 「Seoul National University Intellectual Property Rights Protection Guidelines」)
▶ Maintenance expenses should be for the account of the SNU R&DB Foundation for five years after registration Rights to be abandoned in principle after the sixth year after registration

Procedure for abandonment of intellectual property rights (Article 8-2, 8-3 of the 「Seoul National University Intellectual Property Rights Protection Guidelines」)

▶ Notify the representative inventor of the expected abandonment within three months of the payment date of the fifth annual payment.
▶ Intellectual property rights may be maintained in case the SNU R&DB Foundation deems it necessary.
▶ In case the inventor agrees to pay the maintenance costs the intellectual property rights may be maintained under the name of the SNU R&DB Foundation (additional compensation to be paid to the inventor).
